    Oklahoma Court Says No Withholding Requirement if TIN is Not Given

    Tony Baker did some work for a couple on their home.  They hired him in their private capacity.  When he sent them a bill, they wrongly withheld a portion of the money they owed him.  Tony refused the lower payment and filed a lien against them.  The couple sued Tony and won in the lower court.  However, Tony successfully appealed without lawyer assistance and had the lower court decision vacated.  The appeals court ruled that a person acting in their private capacity is not subject to the federal withholding and information requirements.
