Story leading up to suit filing: April 28, 2008. Tim Kaine, Governor, has never responded to my letters in keeping with Article V, §7 of the Virginia Constitution. I do not have the money to hire a lawyer. I filed a complaint naming me and my son Jesse as the Plaintiffs. Later.... in 2007.... I am now contemplating my next and final letter to the Governor. I am seriously disappointed at what appears to me as a serious breach in the duty of the Governor to faithfully execute the laws of Virginia. It appears so far that the Governor has enabled his delegates to enforce law that oppresses, and he has sanctioned them to completely ignor law that liberates. July 23, 2007. Transportation Secretary Pierce Homer again wrote a letter to me saying the Governor asked him to respond to my letter. He again did not respond to the issues of the religious accommodation request, nor did he touch upon the Religious Freedom Preserved law, the Act for Religious Freedom, or Art. I, Sect. 16 of the Virginia Constitution. The letter again appeared to be an act to dodge my redress attempt. June 22, 2007. I responded to the what I considered an arbitrary letter from Mr. Homer, by sending another letter to Governor Kaine. I reiterated the religious accommodation nature of my request. I cited Virginia Supreme Court rulings upon cases that are on point with my case. I pointed out that I could only find support in the law for my position that I, my family, and those of our religious community, be either accommodated by being able to obtain and retain a driver's license without identifying with a SSN or that the State be enjoined from enforcing our driving without a license due to the unwarranted burden the State was placing upon our religion in order for us to obtain the license. June 20, 2007. Pierce Homer, Secretary of Transporation wrote a letter to me saying that the Governor asked him to respond to my letter but there is no indication that the Governor gave him any directive about how to respond to the letter. The Va. Const., Art V., Sect. 8, provides that the Governor may direct Secretary Homer to submit a writing to the Governor, under oath, but it does not provide that Secretary Homer is to be directed to assume the Governor's obligations under Va. Const., Art. V., Sect. 7, as it relates to this matter. Mr. Homer mentioned nothing of the issue of the religious accommodation request nor of the laws relating to such a request. The letter appeared to be an act to dodge my redress attempt. May 23, 2007. I wrote a formal religious accommodation request to Governor Tim Kaine, because there is a conflict between the statutory requirement to identify with a SSN in order to get a driver's license, and my natural obligation (thus fundamental right) to not identify with the SSN for any reason since it is the number of the beast. I cited the circa 1786 Act for Religious Freedom Code of Va. §57-1, the recent Religious Freedom Preserved Act Code of Va. §57-2.02, the Va. Const., Art I Bill of Rights, Sect. 16 - Free Exercise of Religion, No Establishment of Religion, and other provisions of the Virginia Constitution. I Cited the Governors obligation to the Va. Const., Art V., Sect. 7 - The Governor shall take care that the laws are faithfully executed. The buck stops at the Governor. BACKGROUND Since comming to the conclusion that the SSN is the number of the beast referred to in the book of Revelation, and finding out that there is no law that requires anyone to obtain a SSN to live or work in the United States, I have done everything I can to erradicate the association of my name with a SSN. It resulted in the loss of my Naval career, banking, employment, a driver's license and many other things. I filed suit against the Navy and won [Carmichael v. United States, 66 Fed. Cl. 115 (2005); 298 F.3d 1367 (Aug 2002). Now we have to take on both the State and Federal governments over their implementation of Section 666 of the welfare code that is causing states to prohibit profession, occupational, recreational, driver's and marriage licenses unless the applicants identify themselves with a SSN. I communicated to the Commissioner of the Virginia Department of Motor Vehicles (DMV) that the number on their records was erroneous and asked them to remove it. The DMV issued a customer number for my drivers license records. In 2001 & 2002, applications for renewal came in the mail and they had an SSN pre-printed on it. Thus, my wife and I cannot renew the driver's license applications that were sent to us. We continue to drive and have joined an organization that provides liability coverage for us even in our administratively challenged status. I have requested Virginia to either remove the erroneous and offensive numbers from their records, or cancel the record so that we can submit a new application. Thus far, the government of Virginia has told us that they have no authority to not demand that we associate with SSNs. In each instance, they never addressed the issue that ours was a "religious accommodation" request. Now, I am going straight to Governor Tim Kaine. So far, my correspondence has been diverted. I have no idea if the Governor has actually read my letters. Never-the-less, like the woman Jesus spoke about in Luke, Chapter 18, I am going to harrass them until they render justice for me, my family, my fellow Virginians and countrymen who serve the Lord. |
