Dear Mister Richard C. Holcomb
Thank you for your kind response to my letter which requested you to correct your records. I am begging your mercy with regard to a subject that is become woefully grievous to my soul.
I have dutifully acted to correct all public and private records which attempt to associate my name with a Social Security Number or any like number issued by the current system of commerce which prohibits me from engaging in commerce without identifying with such a number. I have taken the corrective administrative action to cancel any implied or assumed contract mistakenly associating my name with Social Security. I corresponded with the Social Security Administration nine months ago and communicated the requirements of our religious faith which prohibited me and my household from identifying with Social Security Numbers and thus prohibits us from participation in Social Security. I asked Ms. Shirley Chater, Commissioner of Social Security, to tell me within thirty days if there was any other administrative action I needed to take to correct their records and codify to the Social Security Administration and thus the nation that I and my household are exempt from the provisions, requirements, benefits and tracking numbers of the Social Security system. I obtained counsel from constitutional litigators who told me the Commissioner of Social Security would not and could not respond negatively to my plea and thus would tacitly agree with the facts prima facie. If there was another other administrative action to take, Ms. Shirley Chater would have provided the information but there is no other requirement since it is a voluntary benefit program and my religion prohibits me and my household from participating. Judicial procedure supports and insists that this sort of problem be remedied at the lowest administrative level in order to not burden the courts. I have taken all the administrative action necessary to codify that I and my household do not have Social Security Numbers.
The second paragraph of your letter said my wife and I provided social security numbers when applying for our original drivers licenses. I convey to you that the information was given mistakenly while we were not cognizant of the facts that we had never volunteered for such numbers of the voluntary participation social security program. We believed we provided sufficient notice to correct the error when we reapplied for driver's licenses listing no Social Security Number. We are now cognizant of the facts and are willing to testify categorically that we do not have Social Security Numbers because we never volunteered for such a program, we are prohibited by the Living God from participating in the Social Security Program or identifying ourselves with a Social Security Number. I and God alone reserve the unalienable right to establish my identity.
Today you have the right to administer the Department of Motor Vehicles which ever way you seem fit within the boundaries set by the Governor's regulations which must operate within the confines of the law. You have the ability to issue a Driver's license number to every Citizen of Virginia no matter what their age if you so desire. The number you issue only becomes that person's number only when they make a contract with you to agree with your rules and abide by your regulations and that contract is made conscionably with their full understanding of their rights and responsibilities. Until such time as they make such a contract, that number may remain on your files but it does not become that person's unless they agree to make it so. If a person conscionably rescinds their contract with the Department of Motor Vehicles they will no longer have a driver's license and they will no longer have a driver's license number. That number might remain on your files but it is not that person's number (It is the Department of Motor Vehicles number). You have the power to issue Driver's license numbers but you do not have the power to adhere it to a person against their will. Thus so it is with the Social Security Administration. It is a voluntary program. If I have never conscionably made a contract with them, none of the numbers they issue are mine. A number only becomes mine if I apply for one using the SS-5 form and such action is taken conscionably with full knowledge and understanding of my rights and responsibilities. I testify to you that no person on this earth can produce a valid contract that I or my wife ever made with the Social Security Administration and I know full well that my correspondence with Ms. Shirley Chater was sufficient remedy by laws of contract and equity to cancel and make of no effect any erroneous implied contracts.
I testify to you with knowledge and in true and sincere conscience that I, my wife, and all the rest of my household do not have Social Security Numbers and cannot obtain Social Security Numbers due to the prohibitions of my household's religion.
This letter is suitable remedy to correct the erroneous information in Virginia Department of Motor Vehicles files. You have the authority as Commissioner to approve my specific request to correct your files. Virginia statute allows you to use Social Security Numbers but it does not require you to use one by mandate. I beg your mercy upon me and my family.
If you do not feel you can direct your administrators to correct the record by inserting the words "none", "religious prohibition", "999-99-9999" or "000-00-0000" or some like form in the Social Security block, please tell me the appropriate procedures for me to obtain audience with Governor Allen. Since the driver's license you issued me is used as identification for Motor Vehicles Department uses, I must either have your records corrected or I am forced to rescind my driver's license. I still believe America has the elements of a free country and I am personally committed to doing my part to keep it free. Making a correction in your records will not cause an undue administrative burden, it will ensure I am not penalized by loosing my drivers license because of my obedience to God, and I am sure that Thomas Jefferson would take action to correct the record if he was here to do so.
I was born in California but have come to love Virginia. I have been attempting to make myself a Citizen of Virginia because I am proud of it's continued stand for freedom and the principles in which our fathers sacrificed their lives. I beg of you to have mercy on my soul.
