Virginia DMV Commissioner Refuses to Waive The Requirement to Identify With an SSN In Order to Drive in Virginia We finally received a reply from D.B. Smit that brings us to the end of our administrative deliberations. The next step is an action at law. Commissioner Smit conferred with the Virginia Attorney General's office. They have determined that the Comissioner has no authority to waive the requirement to identify with a social security number in order to drive in Virginia. See Smit's letter. The next step is an action at law. What we do here in Virginia has to be a model for what is eventually taken across the country. We have a champion in our corner who is able and willing to take this as high as it needs to go. We have people in Texas, Illinois, Tennessee, West Virginia, Arkansas, New Mexico, Pennsylvania, New York, Maryland and other states who have been waiting for this problem to be taken on properly. It is time.
