The
American Christian
Liberty Society is being organized by David Alan Carmichael,
founder.

I came under the conviction, on the basis of scripture and the leading
of the Holy Spirit, that I cannot participate in Social Security or
identify
with it's number. This came after a hard fought spiritual battle
where I had to count the cost of truly relying upon God as my resource
rather than men. I notified the
Commissioner
of Social Security that I was prohibited from participating in the
Social Security plan and from identifying with it's beastly
number.
I notified her that I rescinded any application made by someone else
intending
it to be on my behalf. From that day forward, October 1, 1996, I
refrained from using that number as my identifier. I contacted
all
agencies that I had given that number to and told them to remove it
from
their records. For the most part, they complied. But not
too
long afterward, possibly from the influence of a new U.S. statute cited
in 42 USC §666, I found that I could not bank, pay my house loan,
vote, pay property tax, work, cash a check, drive or do many other
things
without having to identify myself with the beastly number. Since
I cannot identify with the beastly number, I cannot do those things
which
otherwise are considered commonly available to a free American living
in
Virginia.

In 1996,
I was a Chief Petty Officer in the United States Navy. I asked
for
redress to my Commanding Officer to obtain a religious
accommodation.
I asked the Navy to issue it's own service number as a Military
Personnel
Identification Number (MPIN) rather than using the Social Security
Number
(SSN) that I could not identify with. Those laws and regulations
concerning redress, communication with the commanding officer, reprisal
prohibitions and other things relating to the situation were not just
ignored
by certain key Navy personnel, they were wantonly violated. I was
unlawfully evicted from the Navy on March 17, 1997 without my request
for
accommodation ever being addressed. After my attempts to
administratively
remedy the wrong, I tried to get help from "Christian" legal support
organizations
and lawyers. They refused often arguing against my religious
convictions
rather than discussing the merits of my case. My response to them
was, "Prove my theology wrong by securing my liberty." I filed suit
against
the United States in November of 1998; Pro Se. The Judge,
was
quickly irritated by my claim and was obviously bent on a quick
dismissal
of my case. I again tried to get a Christian lawyer to come to my
rescue. Many I talked to were impressed with the merits of my
case
but felt it was too big for them to take on. At least four that I
talked to recommended I contact Herb Titus. Herb graciously, at
great
personal sacrifice, agreed to take my case in
the
United States Court of Federal Claims. He has fought hard for
four years and undercharged me all along the way. For the
last two years, he has shouldered the expenses himself as I hit the
maximum
on my credit cards. He let me do a great amount of the research
to
save money rather than having the staff of the law firm do the
paralegal
work.
-
We have
gone through
having the case dismissed in the Court of Federal Claims, been to the Court
of Appeals - Federal Circuit where the dismissal was vacated
and remanded, and have secured a significant legal ruling back in
the
Court of Claims whereby Judge Futey ruled I had a firm right to
continue
service through January 17, 1999 at least. We press on in hopes
of
a win and with some restitution.
-
Meanwhile,
we have had
to face not being able to vote, to bank, to drive legally and many
other
things. My wife was recently cited for driving without a license;
a crime in Virginia. However, we had made a request
to obtain a driver's license without identifying with the beastly
number
and the Commissioner refused saying he had no
authority to grant our request. In actuality, the same
statute
that gave him permission to ask for a number cited his authority to
make
an exception. A Virginia Supreme Court ruling says that we can
ignore
the licensing requirement if the commissioner denies it on the
condition
that we forsake a constitutional right. So, the fight is ripe for
the right to use our automobile for private travel on the public
highways.
-
Since
there are many
people in Virginia, and around the country, who have like convictions,
I am convinced that a comprehensive plan must be constructed and
carried
out to take on these issues of law and liberty.
-
I am
pressing on, through
the American Christian Liberty Society, to secure the blessings of
liberty
for ourselves and our posterity.
